Article 1: Scope of application

The general terms and conditions of sale apply exclusively to any current or future commercial relations between Gourmet by nature, 12 rue Anselme 93400 Saint-Ouen France (" we") and the creator of the order ("you"). We can alter these general terms and conditions of sale at any moment, provided that we indicate these changes on our site.

Article 2: Orders

We undertake to accept your order according to the terms of these conditions of sale. When you place your order, we inform you of the availability of products you wish to buy. However, if despite our vigilance, products prove temporarily unavailable (stockout, awaiting new supplies, etc.) after you have placed your order, we will inform you by e-mail and give you the choice of altering or cancelling your order. If any products turn out to be permanently unavailable (depleted stock, etc.) after you have placed your order, we will automatically cancel it and inform you by email before reimbursing any sums you have paid for the unavailable products. By confirming your order, you accept all these general terms and conditions of sale, which you can view on the site, and acknowledge that you are aware of them, thereby renouncing recourse to any contradictory document including your own general purchasing conditions, as the act of purchasing entails acceptance of these general terms and conditions of sale. This confirmation and all the information we have registered constitute proof of our transactions.

Article 3: Prices

Prices are indicated in pound and are deemed to include all taxes due in line with French taxation, excluding carriage costs. We reserve the right to change our prices at any time. We undertake to apply the current prices indicated when you place an order.

Article 4: Payment

Prices are payable immediately on the same date as the order. All our payments by payment cards are processed via PayPal which delivers one of the most secure payment platforms in the world.We accept all major payment cards including Visa, MasterCard, Maestro, American Express, Solo and Discover.

Article 5: Delivery

Unless other arrangements are made, delivery is made to the address indicated when an order is placed. Delivery deadlines are for information only, unless we have exceptionally agreed to deliver on a specific date. We invite you to read the additional information about delivery.

Shipping costs are calculated at the end of your order, depend of your order weight.

Article 6: Cancellation, returns, refunds and claims

We guarantee the quality and condition of all the items we ship.

1. If you wish to cancel an order in whole or in part before it is shipped, please do so by sending an email to service client.

2. We do not deal with returned items except by special agreement. However, pursuant to articles L.121-20 and thereafter of the Consumer Code, you have 14 working days from the delivery date of your order to return any items that do not suit you and request a refund. In all circumstances, the cost of returning items is your responsibility.

Article 7: Latent defect warranty and liability

If any product we have delivered to you proves to have a latent defect, we can decide to eliminate this defect or replace the defective product with another one. If we do not wish to eliminate the defect or replace the defective product, or are unable to do so, or if we are unable to do so within the required time because of circumstances beyond our control, you may, if you wish, send it back to us for a refund of the price and carriage costs, or request a discount on the sale price. The products on offer comply with current French legislation. We undertake to take every care normally applied in the profession when carrying out the service we offer our customers. However, should we fail in our contractual obligations, our liability cannot be incurred if this is due to unforeseeable circumstances or a case of force majeure including but not limited to disasters, strikes, fires, floods, the malfunction or breakdown of equipment, means of transport or means of communication, or due to your actions. Furthermore, our liability cannot be incurred for any delays due to stockout or if there has been an error in the presentation of products on our site, as photographs, texts and illustrations of the products are not contractually binding.

Article 8: Data protection

We undertake to protect your personal data. In agreeing to these general terms and conditions of sale, you acknowledge awareness of our commitment to confidentiality, and authorise us to collect and use this information.

Article 9 : Applicable law and jurisdiction

These general terms and conditions of sale are subject to French law and the Vienna Convention on contracts for the international sale of goods, excluding the United Nations right of sale. Any disputes arising from the commercial relations between you and us fall exclusively within the jurisdiction of the French courts.
